Pharm with Ash End User Agreement

Pharm with Ash (“Pharm with Ash,” “we,” “us,” or “our”) is operated by an individual sole proprietor based in Alberta, Canada. By accessing our website and related online services at https://pharmwithash.ca and associated domains (the “Pharm with Ash Platform”), you agree to these terms and conditions (the “Terms”). These Terms form a legally binding agreement between you and Pharm with Ash.

1. Acceptance of Terms

By using the Pharm with Ash Platform, you agree to be bound by these Terms. If you are using the Pharm with Ash Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We may revise these Terms at any time by updating this page. The date of the most recent revision is noted above. Continued use of the Pharm with Ash Platform constitutes acceptance of the updated Terms.

 

3. Privacy

4. Account Registration and Use

Pharm with Ash offers access to educational content and related services through various subscription plans, which may differ in duration, access limits, or available features. Upon registration and payment of any applicable fees, you are granted a limited, non-exclusive, non-transferable license to access the Pharm with Ash Platform solely for your own educational, non-commercial use, for the period of your active subscription.

We may update, modify, suspend, or discontinue features or access levels at our discretion. Information about current subscription plans is available on our website.

6. Service Content and User Conduct

All materials, content, and resources provided on or through the Pharm with Ash Platform (including but not limited to text, graphics, software, and any interactive tools) are the property of Pharm with Ash or its licensors.

 

You may not copy, distribute, modify, publish, create derivative works from, or commercially exploit any part of the Pharm with Ash Platform except as expressly permitted in writing.

You agree to use the Pharm with Ash Platform only for lawful purposes and not to engage in any activity that:

• Violates any law or regulation;

• Infringes upon the rights of Pharm with Ash or any third party;

• Harms, threatens, or harasses others;

• Attempts to gain unauthorized access to any part of the Pharm with Ash Platform or related systems.

7. Platform Features, Beta Services, and Updates

Pharm with Ash may from time to time make new features or functionalities available, including pilot, trial, or beta services. Access to any feature or content is at Pharm with Ash’s discretion and may change or be discontinued without notice. Certain services may rely on automated or artificial intelligence technologies and are provided for educational support only, not as a substitute for professional advice.

8. User Content and Community Guidelines

Where the Pharm with Ash Platform allows you to submit, post, or share content (including feedback, discussions, or other contributions), you grant Pharm with Ash a non-exclusive, worldwide, royalty-free license to use, display, adapt, and distribute that content for the purpose of operating and improving the Platform. You agree not to post content that is unlawful, infringing, abusive, or otherwise objectionable, and you acknowledge that Pharm with Ash may moderate or remove content at its discretion.

9. Data, Analytics, and Leaderboards

Pharm with Ash may collect and process data regarding your use of the Platform for purposes including, but not limited to, performance analytics, progress tracking, and service improvement. In some cases, anonymized or pseudonymized data may be displayed in aggregate form (such as achievement boards or rankings). By using the Platform, you consent to such data processing and display, unless you opt out through your privacy settings.

10. Disclaimer of Warranties

The Pharm with Ash Platform and all related content are provided “as is” and “as available,” without warranties of any kind, express or implied. Pharm with Ash disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Pharm with Ash does not guarantee that the Platform or any content is accurate, complete, or error-free, or that access will be uninterrupted.

11. Limitation of Liability

To the fullest extent permitted by law, Pharm with Ash and its representatives are not liable for any indirect, incidental, consequential, punitive, or special damages arising out of or in connection with your use of (or inability to use) the Pharm with Ash Platform. In no event will our aggregate liability exceed the amounts you have paid to us, if any, for access to the Platform.

12. Indemnification

You agree to indemnify and hold harmless Pharm with Ash and its representatives from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the Platform or your violation of these Terms.

 

13. Termination

We reserve the right to suspend or terminate your account and access to the Pharm with Ash Platform at our discretion, including for any violation of these Terms. Upon termination, your rights to use the Platform will cease immediately.

14. Governing Law

These Terms are governed by the laws of Alberta, Canada. Any disputes arising from or related to these Terms or the Pharm with Ash Platform will be resolved by arbitration or courts in Alberta, Canada, unless otherwise required by law.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies or agreements, constitute the entire agreement between you and Pharm with Ash relating to your use of the Platform.
